The General Director hereby informs all employees of HAPUMA about the case involving Tang Xuan Huy, former employee of the Design Department, who violated the law, breached Company labor regulations and compromised Company confidentiality policies as follows:
Between August and October 2021, Tang Xuan Huy repeatedly and illegally copied confidential design data, removed it from the Company without authorization and provided design services to external parties, including several direct competitors.
On May 15, 2024, during the first-instance trial, the People’s Court of Hai Duong City, Hai Duong Province, concluded:
“The defendant’s actions are dangerous to society, interfere with proper business operations and significantly impact the research, production and business activities of Hai Duong Pump Manufacturing Joint Stock Company… The defendant’s actions constitute the crime of misappropriating work secrets.”
“The prosecution by the People’s Procuracy of Hai Duong City against the defendant is justified.”
Accordingly, the Court found Tang Xuan Huy guilty of misappropriating work secrets and sentenced him to 2 years and 3 months of suspended imprisonment with a probation period of 4 years and 6 months, effective from the date of the first-instance verdict. The Court further ordered that Tang Xuan Huy be supervised and educated by the People’s Committee of Gia Xuyen Commune, Hai Duong City during the probation period (excerpted from First-Instance Criminal Judgment No. 64/2024/HS-ST).
The General Director reminds all employees that any action or statement that discloses confidential work information violates both Company labor regulations and the law.
